BURLINGTON — There will be no change to the result of a hotly contested Burlington City Council race, after a superior court judge shot down an attempt by a losing candidate to include four ballots election officials had disqualified.
Judge Samuel Hoar denied the appeal by Ward 7 Democratic candidate Aleczander Stith during a Monday hearing in Chittenden Superior Court.
Stith argued that the March 1 election results — which had independent incumbent Ali Dieng winning by two votes — should factor in four absentee ballots that were submitted incorrectly because city officials did not give the voters an appropriate opportunity to fix their errors.

Hoar rejected that assertion. In a decision delivered moments after oral arguments concluded, the judge said Associate City Clerk Sarah Montgomery met her legal obligation to contact the voters.
