Top Shelf Golf LLC shook off false advertising and computer fraud claims by golf cart retailer Motogolf.com for allegedly clicking on Motogolf’s pay-per-click online ads in order to conceal them and drive up its advertising expenses, according to a Nevada federal court ruling.
Motogolf’s false advertising claim under the Lanham Act fails because Top Shelf’s alleged clicking activity isn’t commercial advertising about its own or another’s product, the U.S. District Court for the District of Nevada said Monday.
